NY Interlock Device: Installation and Duration Rules After DWI

On Behalf of Law Office of Randy S. Alpert | Nov 25, 2025 | DWI Defense

A DWI conviction in New York initiates a serious process that profoundly affects a driver’s privileges. Understanding these requirements is essential for moving forward successfully. Facing the immediate aftermath of a DWI, individuals need clear facts about state mandates to ensure full compliance. One of the most critical steps involves the installation of an ignition interlock device (IID) in the offender’s vehicle.

Why Drivers Need an Interlock Device

New York State law mandates the IID to prevent reoffending and protect the public. Leandra’s Law, passed in 2010, requires the installation of an IID following a misdemeanor or felony DWI conviction.

The device ensures the driver provides a clean breath sample before the car will start, directly serving as a critical safety measure. This law makes device installation a non-negotiable part of the sentencing and probation process.

Installation and Duration Rules

Once a court convicts a driver of a DWI offense, that individual must install the device into all cars they own or operate. The driver must complete this installation within ten days of the court order. The length of the requirement corresponds to the conditional discharge or probation period, but the law sets a minimum duration of six months. The driver bears the full cost of the installation and the monthly monitoring fees.

Failure to comply with the order or any attempts to tamper with the device result in immediate legal issues, including potential revocation of the license and further criminal charges.

Protecting one’s future

The penalties and compliance requirements for a DWI conviction can be complicated. The accused individual faces potential jail time, huge fines, and lasting legal consequences. An experienced defense lawyer can help anyone facing charges deal with these severe mandates. A lawyer can aggressively fight to challenge the charge or citation, often negotiating for reduced penalties, dramatically minimizing the burden on one’s life.
